According to the Department of Justice (DOJ), State and Local Government (Title II) entities are required to develop a Self-Evaluation and Transition Plan to document compliance and are expected to provide regular updates (preferably every 4 years) to show their progress towards removing any noted barriers with the provisions of the Americans with Disabilities Act (ADA) signed on July 26, 1990. The ADA Self-Evaluation and Transition Plan are significant in that it establishes the entity’s ongoing commitment to the development and maintenance of policies, programs, and facilities that are inclusive to all of their citizens.

All public entities subject to Title II of the ADA must complete a Self-Evaluation.  For public entities that have 50 or more employees, there is also a requirement to have a Transition Plan in place that addresses structural changes that are necessary for achieving program accessibility.  This July 26, 2020, will mark the 30th anniversary of the signing of the ADA!  In other words, that’s 30 years your agency has been required to have a Transition Plan in place and provide continual updates.  If you do not have a Transition Plan or you have not updated your Transition Plan in the last four years, then you are at high risk of having federal funds withheld and an easy target for lawsuits. Starting and maintaining a Transition Plan can feel like a daunting task, but Kristi breaks it down into simpler steps you can implement back at your agency.
